第1条　適用範囲

本規約は、Pcolle（以下「当サイト」といいます）を利用するすべての会員に適用されます。会員は当サイトを利用した時点で、本規約の内容に同意したものとみなされます。

第2条　規約の変更

当サイトは、会員に事前通知することなく、本規約の内容を変更する場合があります。変更後の規約は当サイト上に掲示された時点で効力を生じるものとし、以降の利用については変更後の規約に同意したものとみなします。

第3条　会員登録と管理

1. 会員登録は、当サイト所定のフォームに必要事項を正確に記入のうえ送信することにより完了します。販売会員、購入会員、アフィリエイト会員の登録はそれぞれ別個に行う必要があります。※同一人物が複数の種類の会員として重複登録することも可能です。
2. 会員は、登録したメールアドレスおよびパスワードの管理について責任を負うものとします。第三者による不正使用等による損害について、当サイトは一切責任を負いません。
3. 登録情報に虚偽があった場合、または不適切な行為が確認された場合、当サイトは登録を抹消し、法的措置を取ることができるものとします。

第4条　サービスの提供内容

1. 当サイトは、18歳以上の利用者を対象とした、ファイルのダウンロードおよびアップロードによる売買環境と決済手段を提供します。
2. 当サイトは取引の場を提供するものであり、販売されるファイルの内容や品質について一切の保証を行いません。
3. 売買契約は購入会員と販売会員の間で直接成立し、当サイトは契約の当事者ではありません。
4. 代金の徴収は販売会員に代わって当サイトが行います。

第5条　支払い方法および決済手数料

1. 支払い方法は以下のいずれかとします：
   
   1. クレジットカード決済（VISA、MasterCard、JCB）
   2. 銀行振込
2. クレジットカード決済で1,000円未満の購入には、50円の手数料が商品価格に加算されます。Pポイントを併用する場合、ポイント使用前の金額が1,000円以上であれば手数料は免除されます。
3. 銀行振込に係る手数料は会員が負担するものとします。振込額が過少の場合は返金されず、期限内に不足分を再度お振込みください。過大入金の場合、超過分は「1円＝1P」でPポイントとして振り替えられます。

第6条　ダウンロードおよび閲覧期間

購入した商品は、購入日を含め14日間ダウンロードが可能です。期間を過ぎた場合、再ダウンロードはできません。

第7条　返金ポリシー

1. 正常なダウンロードおよび視聴が当社システム上で確認された場合、返金には応じません。
2. 会員の端末環境や通信環境に起因する不具合についても、返金の対象外とします。
3. 商品説明やサンプル画像の内容と実際の商品が一部異なる、イメージと違ったといった主観的な理由による返金要請には、いかなる場合も応じかねます。
4. システムエラーにより多重決済が発生した場合は、重複分に限り請求の取消処理または返金を行います。

第8条　Pポイントの取り扱い

1. Pポイントは1ポイント＝1円として商品購入に利用できます。
2. ポイントは、取得日から180日間有効で、古い順に消費されます。期限切れのポイントは利用できず、未使用でも現金化はできません。
3. 複数アカウントのポイント合算、第三者への譲渡・質入れはできません。
4. ポイント使用に際し、会員IDおよびパスワードが一致していれば、本人使用とみなします。不正使用による損害について当サイトは責任を負いません。
5. 瑕疵によるキャンセル時はポイントを差し戻します。ただし、処理上の都合により現金で返金される場合もあります。
6. 退会時の未使用ポイントは失効します。
7. 以下の場合、保有ポイントの一部または全部を取り消すことがあります：
   
   1. 違法または不正行為
   2. 本規約等への違反
   3. 当サイトが取り消しを適切と判断した場合

第9条　退会

会員は、マイページに設置された退会フォームより自ら退会手続きを行うことができます。退会後は購入履歴、ダウンロード権、ポイント、称号はすべて消失します。マイページにアクセスできないなどやむを得ない事情がある場合は、アカウント所有者であることを確認できる情報を添えて、お問い合わせフォームより退会申請を行うことができます。

第10条　禁止行為

会員は、当サイトを利用するにあたり、以下の行為を行ってはなりません。これらの行為が確認された場合、当サイトは事前通知なくアカウントの停止、削除、退会、法的措置などの対応を行うことがあります。

1. 当サイトまたは運営者への誹謗中傷、脅迫、威圧的な言動、不当なクレームの繰り返し
2. 虚偽の登録情報、または他人になりすましての利用
3. サイトの運営を妨げる行為（不正なアクセス、過度なリクエスト、BOT・スクリプトの使用など）
4. 商品データ（動画・画像・テキスト等）の無断転載、再配布、複製、改変、公衆送信、商用利用
5. 購入コンテンツを第三者に譲渡、販売、共有する行為
6. ポイントや購入履歴を不正に取得・利用する行為（多重アカウント登録等を含む）
7. その他、当サイトが不適切と判断する行為

第11条　免責事項

1. 商品内容の保証、損害の補償、通信・システム障害による損害、第三者による不正アクセスなど、いかなる損害についても当サイトは一切責任を負いません。
2. 本サービスの終了や変更も事前通知なく行うことがあり、会員はこれを承諾するものとします。

第12条　個人情報の取り扱い

当サイトは、裁判所の命令等による場合を除き、会員の個人情報を第三者に開示しません。開示する場合は、会員に通知します。

第13条　削除依頼

掲載中の商品に関する削除依頼は、本人、正規代理人、権利者、または法的機関に限り受け付けます。本人確認のため、身分証明書等の提出を要請する場合があります。

第14条　準拠法および管轄

本規約は日本法に準拠します。本サービスに関連する訴訟については、当サイトが指定する裁判所を専属的合意管轄裁判所とします。

第15条　規約違反の通報

ユーザーは、他のユーザーによる規約違反を発見した場合、速やかに当サイトへ報告してください。

第16条　苦情および紛争の申立て

会員は、サービスの利用に関する苦情や問題について、当サイトのお問い合わせフォームを通じて申し立てることができます。当サイトは、これらの申し立てに対して合理的な期間内に対応するよう努めます。 チャージバックや不正請求に該当する申立てについては、当サイトにて取引履歴および利用状況を確認のうえ、正当な請求であることが確認された場合は必要な対応（返金または再処理）を行います。不正または不当なチャージバックが認められた場合は、反論の申し立てを行う場合があります。

第1条　適用範囲

本規約は、Pcolle（以下「当サイト」といいます）の販売会員に適用されます。販売会員は本規約に加えて、「Pcolle会員利用規約」にも同意したものとみなされます。

第2条　販売会員の登録

販売会員として登録するには、18歳以上であることが必要です。登録は当サイト所定の手続きを行うことで申請できます。ただし、以下のいずれかに該当する場合、登録をお断りすることがあります。

• 過去に当サイトの規約違反などで利用を制限された方
• 当サイトが不適切と判断した方

第3条　本人確認

販売会員として登録後、本人確認のため書類提出が必要です。以下の要件を満たす書類を、当サイト指定の方法で提出してください。

• 個人の場合：運転免許証・住民票など、住所が記載された公的書類
• 法人の場合：履歴事項全部証明書等

本人確認が完了するまで、商品の公開や売上金の支払いは保留されます。
複数アカウントを利用する場合、それぞれのアカウントで本人確認が必要です。
また、反社会的勢力との関わりがある方の利用はお断りします。
虚偽の登録や連絡不能が判明した場合、会員資格を停止し、売上金を凍結することがあります。
無修正・児童ポルノと判断されるコンテンツについては、関係機関へ通報することがあります。

第4条　アダルトコンテンツの取り扱い

アダルトコンテンツを取り扱う場合、法律上の義務や必要な手続きを遵守してください。

• 自身の運営するWebサイトで性的表現を含むコンテンツを販売する場合は、「映像送信型性風俗特殊営業」の届出を自身の名義で行う必要があります。届出の際は当サイトの情報ではなく、ご自身の販売サイトのURL、お名前、住所にてご申請ください。
• モデルを使用する場合は、年齢確認を行ったうえで以下の資料を保管してください：
  
  • 顔写真付き身分証のコピー
  • 身分証を手に持った本人の写真
  • 日付・署名入りの出演同意書

第5条　販売禁止商品

当サイトでは、以下に該当する商品を販売できません。該当商品が登録された場合、当サイトは削除・非公開・販売停止などの措置を取ります。

• 児童ポルノに該当、または誤解されるおそれのあるもの
• 無修正の性器映像や写真
• 他人の著作権・肖像権・プライバシー権などを侵害するおそれのあるもの
• トイレや風呂の盗撮、または盗撮が疑われるもの
• 嘔吐・放尿・飲尿・排泄物を含むスカトロ表現
• フィストファック・チョーキング・スパンキング等、暴力的・残虐な表現
• 盗撮により撮影され、着衣内部が映っているもの
• モデルの年齢確認が不十分、または書類提出ができないもの
• インターネットや携帯電話などから収集した転用コンテンツ
• ネズミ講やマルチ商法等に関連する内容
• 他人の名誉を毀損、誹謗中傷する内容
• 人身売買・身体的虐待を助長・肯定する内容
• 出演者の同意が確認できないコンテンツ
• その他、当サイトが不適切と判断するもの

さらに以下の商品は、発見次第即時販売停止・アカウント凍結の対象となります。関係当局から開示要請があった場合、令状の有無を問わず情報を開示します。

• 児童ポルノ
• 無修正の性器映像
• 転売商品

※児童ポルノの定義は「児童買春・児童ポルノ禁止法」等に基づきます。
※15歳未満（中学生以下）のモデルを用いた商品は販売禁止です。
※JS・ランドセル画像など児童を連想させる表現を含む商品も販売できません。
※獣姦を描写・連想させる画像、映像、テキスト、タグ等も禁止対象です。

第6条　販売可能商品

当サイトで販売できるのは、以下の条件をすべて満たす商品です。販売会員は、登録前にこれらの条件を確認してください。

• 販売権限を有すること：販売会員自身が正当な権利を持ち、第三者の著作権・肖像権・プライバシー権などを侵害しないこと
• 日本法令に違反しないこと：販売・所持・配布が違法でないこと
• 違法な勧誘等を含まないこと：ネズミ講、マルチ商法、情報商材に関連しないこと
• 誹謗中傷・名誉毀損を含まないこと：社会的評価を低下させる表現がないこと

第7条　販売ルール

販売会員は、当サイトで商品を販売するにあたり、以下のルールを守らなければなりません。

• 同じ内容の商品を複数登録することはできません（セット商品を除く）。
• 「再販商品」「音声なし」「4K」など該当する補足情報には必ずチェックを入れてください。
• 外部アップローダーを利用してファイルを提供することは禁止します。
• 他のマーケットプレイスへの誘導や宣伝目的の記載は禁止します。
• 商品説明は購入者に内容が正しく伝わるよう具体的かつ誠実に記載してください。
• 違反があった場合、当サイトは独自の判断で販売停止・商品削除など必要な措置を行います。
• 商品説明欄に「返金やクレームは一切受け付けません」といった記載を行うことは禁止します。当サイトが必要と判断した場合は販売会員に代わって返金等の対応を行うことがあります。
• サンプル画像は、本編に実際に含まれるシーンから適切にキャプチャされたものを使用してください。組み合わせ加工や、実際の映像に存在しないカットの使用は禁止です。
• サンプル画像の加工は、性器の塗りつぶし・顔のモザイク・テロップ挿入に限って許容されますが、内容の印象を著しく操作するようなコラージュや演出過多の画像は禁止します。

第8条　規約違反への対応

当サイトは、販売会員による規約違反が疑われる場合、以下の対応を行うことがあります。

• 規約違反の疑いがある商品について、一時的に販売を停止し、事実確認を行います。
• 明らかな違反と判断した場合、当該商品の販売停止または削除を行います。
• 出演者・関係者・販売元から正式な削除依頼があった場合は、事情確認後、該当商品の販売停止または削除を行う場合があります。
• 当サイトの判断に対して異議申し立ては受け付けません。
• 販売会員の主張に関わらず、当サイトが不適切と判断する商品は販売できません。

第9条　著作権・委託販売

販売会員は、自身が販売する商品について、著作権など第三者の権利を侵害しないことを保証します。

著作権侵害が疑われる場合、当サイトから以下の資料提出を求めることがあります。

• 撮影時の原版画像（Exif情報付き画像など）
• 販売委託を証明する書類（委託者名・連絡先・契約内容などが明記された有効な書類）

提出できない場合、当サイトは権利を有していないとみなし、販売停止など必要な措置を取ることがあります。

第10条　商品内容に関する責任

販売会員は、販売するデジタルデータが合法かつ瑕疵のないことを保証しなければなりません。

• 第三者との間で発生したトラブルや損害賠償請求については、販売会員がすべての責任と費用を負担します。
• デジタルデータに破損や動作不良があった場合は、販売会員が購入者へ正常データの再提供、または返金対応を行うものとします。
• 当サイトはデジタルデータの品質について一切の責任を負いません。

第11条　販売期間と削除

販売会員は、商品の販売を任意に停止できます。ただし、購入者のダウンロード可能期間が終了するまで、商品削除はできません。

次のいずれかに該当する場合、当サイトは商品の削除を行うことがあります。

• 規約違反が確認された場合
• 身分証や出演同意書などの提出要請に応じない場合
• 警察、裁判所等の公的機関、決済会社、インターネットサービスプロバイダから削除要請があった場合
• 商品が14日間以上非公開状態に設定されている場合
• 新規登録商品が14日以内に公開されなかった場合
• 修正依頼に14日以内に対応がなされなかった場合

第12条　販売数・販売手数料

当サイトでは、販売可能な商品数に基本的な制限は設けません。ただし、以下の場合、当サイトの裁量で制限を設けることがあります。

• 不当に販売数を増やしていると当サイトが判断した場合

販売手数料については、以下の通りとします。

• 商品が売れた際、販売価格から手数料およびアフィリエイト報酬を差し引きます。
• 複数商品が同時に売れた場合、1商品ごとに手数料が発生します。
• 手数料率は変更される場合があり、その際は事前に告知します。

第13条　支払いおよび振込

販売会員の売上金は、以下の条件に基づき支払われます。

• 月末締め翌月末払い（売上金額が10,000円を超えた場合に振込）
• 振込手数料（300円＋税）は販売会員負担とし、売上金から控除します。
• 振込エラーで組戻しが発生した場合、再振込手数料（600円＋税）を控除し、翌々月末に再振込します。

第14条　売上キャンセルと返金

以下の場合、当サイトは売上のキャンセルや返金処理を行います。

• クレジットカードの不正利用や利用拒否により、カード会社から売上キャンセル通知があった場合
• 販売会員が対応不十分で、購入会員からのクレームについて当サイトが返金を適当と判断した場合

支払済の売上についても、次回売上から控除、または販売会員に返金請求を行う場合があります。

第15条　消費税

販売会員の主たる事業所が日本国内にある場合、当サイトでの売上に関する消費税について、販売会員はリバースチャージ方式を理解し、適用に同意したものとみなされます。

第16条　会員資格の停止・抹消

当サイトは、販売会員が以下に該当する場合、予告なく会員資格の停止・抹消を行うことがあります。

• 規約違反があった場合
• 登録情報に虚偽があった場合
• 連絡不能が続いた場合
• パスワードの不正使用があった場合
• 当サイトに損害を与える行為を行った場合
• 当サイトや他会員に対する誹謗中傷・迷惑行為を行った場合
• その他、当サイトが著しく不適切と判断した場合

特に児童ポルノや無修正映像の販売など重大な規約違反については、即時抹消・売上金の凍結・関係当局への通報などの措置を取ることがあります。

第17条　退会

販売会員は、マイページの退会フォームから自由に退会することができます。
未払い売上金が3,000円以上ある場合、振込手数料を差し引いた上で指定口座に振込されます。
退会後、当サイトには商品ファイルの保存義務はありません。

第18条　準拠法および裁判管轄

本規約は日本法に基づき解釈されます。
当サイトに関する紛争については、当サイトが指定する裁判所を第一審の専属的合意管轄裁判所とします。

第19条　違反通報

会員が他の会員による規約違反を発見した場合、当サイト運営事務局に通報することができます。違反の有無については当サイトが独自に判断し、結果については開示いたしません。

第20条　規約の改定

本規約は、必要に応じて当サイトが改定します。
改定後の規約は、当サイトに掲載された時点で効力を有し、以降の利用は改定内容に同意したものとみなされます。

本規約は、Pcolle（以下「当サイト」といいます）のアフィリエイトプログラムに参加するすべてのアフィリエイト会員（以下「会員」といいます）に適用されます。会員は、本規約および別途定める「Pcolle会員利用規約」に同意したものとみなされます。

第2条　登録と参加条件

1. 会員登録は無料であり、入会金や月額利用料等は一切かかりません。
2. アフィリエイトプログラムへの参加を希望する方は、当サイト指定の登録フォームに必要事項を正確に入力し、申請を行ってください。
3. 以下に該当する場合、当サイトは登録を拒否または解除することがあります：
   
   • 登録内容に虚偽がある場合
   • 宣伝用に登録されたURLが無効または存在しない場合
   • 宣伝活動の実態が確認できない場合
   • 登録者が18歳未満であると判明した場合
   • 宣伝媒体上で違法行為や差別的な内容の掲載がある場合
4. 登録後も随時審査を行い、運営上不適切と判断された場合には、事前通知なくアカウントを解除できるものとします。
5. 長期間連絡が取れない状態が続いた場合、アカウントを一時停止・削除する場合があります。

第3条　報酬について

1. アフィリエイト報酬は、会員が提供するアフィリエイトリンクを経由して当サイトに訪問し、購入が発生した場合に発生します。
2. 報酬は「販売価格 × アフィリエイト率」により計算されます。アフィリエイト率は販売会員が10%～50%の間で自由に設定できます。
3. アフィリエイトリンクを経由した後に、他の商品を購入した場合も報酬対象となります。
4. 自己アフィリエイトは禁止されていませんが、実質的な宣伝活動が確認できない場合には利用制限またはアカウント停止の対象となることがあります。
5. 会員自身が販売している商品を宣伝することも可能ですが、他の販売会員の商品を不当に貶める行為は禁止されます。

第4条　報酬の支払い

1. 報酬が10,000円を超えた場合、会員が指定した日本国内の銀行口座へ振り込まれます。
2. 初回のみ、登録ボーナス1万円とアフィリエイト報酬1万円の合計2万円を超えた時点で支払対象となります。
3. 報酬は月末締めで集計され、翌月末に支払われます。金融機関休業日の場合は翌営業日となります。
4. 振込手数料（300円＋消費税）は会員負担とし、報酬から差し引かれます。
5. 振込エラーによる組戻しが発生した場合は、組戻し手数料（600円＋税）＋再振込手数料を差し引いて再送金します。
6. 本人確認が必要と判断された場合、当サイトは本人確認書類の提出を求めることがあります。提出がない場合、支払いを停止することがあります。
7. 報酬の支払い対象とならなかった月の未支払分は失効することはありません。翌月以降に累積し、支払条件（10,000円以上）を満たした時点で支払い対象となります。

第5条　報酬制度の特典

1. 会員には、前月の売上に応じて称号が付与され、売上ごとに1%～8%の追加報酬が加算されます（ブロンズ～ダイヤモンドまで）。
2. 前月の報酬が1万円を超えた場合には、5000円分のPポイントが付与されます。
3. このボーナスを受け取るには、事前に購入会員とのアカウント連携設定を行っている必要があります。事後連携では遡及付与できません。
4. アフィリエイト報酬に関する称号やPポイントボーナスの条件・内容は、事前告知のうえ変更されることがあります。

第6条　禁止行為

以下の行為は禁止されており、違反があった場合は報酬の取消、アカウントの停止、契約解除、法的措置が行われる場合があります。

• 虚偽または誇張した表現での宣伝
• モデルや販売会員に対する誹謗中傷及び個人情報を特定する行為
• 販売会員の評価を不当に下げる行為
• 許可されていない素材（動画・画像等）の無断使用
• 他サイトへの誘導を目的としたPcolle素材の使用
• PcolleやPcolleの商品の宣伝が伴わない宣伝素材の使用
• Pcolleを偽装したサイトやページの作成
• Pcolleの入り口ページを模したコンテンツの作成
• Pcolleのロゴ・アイコン・ブランド類似デザインの無断使用
• SNS等での「公式アカウント」を詐称し、当サイト公式であると誤認させる行為
• リスティング広告等で「Pcolle」名義の無断出稿
• サーバーに過剰な負荷を与える行為
• リダイレクト、ポップアップ、ポップアンダー、フレーム内でPcolleを表示する行為
• ユーザーの個人情報やメールアドレスの収集を伴う宣伝
• 自動化ツールやスクリプトを使用した無断のプロモーション行為
• 公序良俗に反する内容の宣伝
• 誤解を与える価格・期間表示や虚偽の割引表現
• 無断メール配信・スパム行為
• 自己アフィリエイトを過度に繰り返す行為（報酬目的での複数回自己購入など）

第7条　削除要請への対応

出演者、販売会員、権利者、関係者、または当サイトの運営事務局より、会員が公開した記事や投稿の削除または修正を求められた場合は、速やかに対応しなければなりません。
対応がなされない場合、当サイトは報酬の保留、アカウント停止等の措置を取ることがあります。

第8条　登録情報の変更

会員は登録内容（銀行口座・宣伝サイトURL等）に変更があった場合、速やかにマイページ上で修正手続きを行う必要があります。変更がなされずに通知不能となった場合、当サイトは責任を負いません。

第9条　退会と未払い報酬の取り扱い

会員はいつでもマイページの退会フォームから退会することができます。
退会時に未払い報酬が3,000円以上ある場合は、手数料を差し引いた上で登録口座に振込まれます。
アフィリエイト登録時のボーナスは、当該ボーナスに付随する条件を達成した場合に限り支払対象となります。条件未達成のまま退会した場合、当該キャンペーン報酬は支払われず失効します。
キャンペーン内容は、事前の予告なく変更または終了することがあります。

第10条　免責事項

1. 会員の宣伝活動によるリンク切れ、クリックカウントの欠損、トラッキング失敗、報酬集計ミス等に関して、当サイトは責任を負いません。
2. 外部システムやブラウザの仕様変更等により予期せぬ挙動が生じる場合があります。

第11条　個人情報の取り扱い

当サイトは、裁判所の命令など法的義務がある場合を除き、会員の個人情報を第三者に提供することはありません。情報を提供する際には、原則として事前に本人に通知します。

第12条　準拠法と裁判管轄

本規約の解釈および適用には日本法を準拠法とし、本サービスに関する紛争が生じた場合は、当サイトが指定する日本国内の裁判所を第一審の専属的合意管轄裁判所とします。

Article 1 – Scope of Application

These Terms of Use apply to all members who use Pcolle (hereinafter referred to as "the Site"). By using the Site, members are deemed to have agreed to the content of these Terms.

Article 2 – Revisions to the Terms

The Site may revise these Terms without prior notice. Revised Terms shall become effective at the time they are posted on the Site, and continued use of the Site thereafter shall be deemed acceptance of the revised Terms.

Article 3 – Member Registration and Management

Registration is completed by accurately filling out and submitting the Site’s designated registration form.
Separate registration is required for each type of member (seller, buyer, affiliate), and one person may hold multiple member types.
Members are responsible for managing their registered email address and password. The Site is not liable for any damages caused by unauthorized use by third parties.
If false information is registered or inappropriate behavior is found, the Site may cancel the membership and take legal action.

Article 4 – Services Provided

The Site provides an environment for the purchase and sale of files via upload/download and offers payment processing services for users aged 18 or older.
The Site only provides a transaction platform and does not guarantee the content or quality of any files sold.
Sales contracts are established directly between buyer and seller, and the Site is not a party to those contracts.
The Site collects payments on behalf of the sellers.

Article 5 – Payment Methods and Fees

Available payment methods:

• Credit card (VISA, MasterCard, JCB)
• Bank transfer

For credit card purchases under ¥1,000, a handling fee of ¥50 will be added to the product price. If P Points are used and the pre-discount total is ¥1,000 or more, the fee is waived.
Bank transfer fees must be paid by the member. Underpayment will not be refunded, and the member must re-transfer the shortfall.
In case of overpayment, the excess amount will be credited as P Points (¥1 = 1P).

Article 6 – Download and Viewing Period

Purchased content may be downloaded for 14 days from the purchase date. Downloads are not available after this period.

Article 7 – Refund Policy

No refunds will be issued if successful download and playback are confirmed by the Site’s system.
Issues caused by the member’s device or internet environment are not grounds for refund.
Refund requests based on subjective reasons (e.g., content not as imagined, sample differences) will not be accepted.
In case of system error resulting in duplicate payments, refunds or cancellations will be made for the excess portion only.

Article 8 – Handling of P Points

P Points can be used as payment at a rate of 1P = ¥1.
Points are valid for 180 days from the acquisition date and are used in chronological order.
Expired points cannot be used or refunded.
Points may not be combined across accounts, transferred, or pledged.
If the correct member ID and password are used, point usage is considered authorized by the member.
In case of cancellation due to defects, points will be returned. However, cash refunds may occur based on operational reasons.
Unused points will expire upon account termination.

Points may be revoked in whole or in part under the following conditions:

• Illegal or fraudulent activity
• Violation of these Terms
• When deemed appropriate by the Site

Article 9 – Account Termination会

Members may voluntarily terminate their account through the form provided in the My Page section.
Upon termination, purchase history, download rights, points, and ranks will be lost.
If access to My Page is not possible, members may request account termination by submitting verifiable ownership information via the contact form.

Article 10 – Prohibited Conduct

Members must not engage in the following acts. If such conduct is confirmed, the Site may suspend, delete, or terminate the account without prior notice and may take legal action:

1. efamation, threats, intimidation, or repeated unreasonable complaints against the Site or its operators
2. False registration or impersonation
3. Interference with site operations (e.g., unauthorized access, excessive requests, bot/script use)
4. Unauthorized reproduction, redistribution, or modification of content
5. Sharing or selling purchased content to third parties
6. Fraudulent acquisition/use of points or purchase history
7. Any other conduct deemed inappropriate by the Site

Article 11 – Disclaimers

The Site assumes no liability for damages related to content, communication failures, system errors, or unauthorized third-party access.
Services may be changed or terminated without prior notice, and members accept such changes by using the Site.

Article 12 – Handling of Personal Information

The Site will not disclose personal information to third parties unless required by law. If disclosure occurs, members will be notified.

Article 13 – Content Removal Requests

Requests to remove content must be submitted by the individual, their legal representative, rights holder, or an official legal entity.
Identification documents may be required for verification.

Article 14 – Governing Law and Jurisdiction

These Terms shall be governed by Japanese law.
Any disputes related to the service shall be subject to the exclusive jurisdiction of a court designated by the Site.

Article 15 – Reporting Violations

If a user discovers another user violating these Terms, they are encouraged to report it to the Site promptly.

Article 16 – Complaints and Dispute Resolution

Members may submit complaints or disputes regarding service use via the Site’s contact form.
The Site will make reasonable efforts to respond within an appropriate timeframe.
For chargebacks or suspected fraudulent claims, the Site will verify the transaction history and usage status.
If the charge is deemed valid, the Site will process a refund or cancellation as necessary.
If the claim is found to be fraudulent or unjustified, the Site may dispute it.

Article 1 – Scope of Application

These Terms apply to all sellers registered with Pcolle (hereinafter referred to as "the Site"). Sellers are also deemed to have agreed to the Pcolle General Member Terms of Use.

Article 2 – Seller Registration

To register as a seller, applicants must be 18 years of age or older.
Registration is done through the procedure specified by the Site. However, registration may be denied in the following cases:

• If the applicant was previously restricted from using the Site due to violations
• If the Site deems the applicant inappropriate for any reason

Article 3 – Identity Verification

After registration, sellers must submit documents for identity verification via the method designated by the Site.

• For individuals:Government-issued documents showing name and address (e.g., driver’s license, resident record)
• For corporations:Certified copy of the company registry

No products will be published, and no payouts will be made until verification is completed.
Each seller account requires individual identity verification.
Those affiliated with organized crime groups will be denied access.
If false information or non-communication is identified, account suspension and earnings freeze may occur.
Any content deemed uncensored or child pornography will be reported to relevant authorities.

Article 4 – Handling of Adult Content

When handling adult content, sellers must comply with all applicable laws and regulations.

• If selling sexually explicit content via a personally operated website, sellers must file a notification under the Japanese "Act on Control and Improvement of Amusement Businesses" under their own name and site information—not that of Pcolle.
• When models are used, the following documents must be retained:
  
  • Copy of a government-issued photo ID
  • Photo of the model holding the ID
  • Signed model release form including date and signature

Article 5 – Prohibited Products

The following content is strictly prohibited. If registered, the Site may delete, unpublish, or suspend sales:

• Content involving or potentially interpreted as child pornography
• Uncensored genital images or videos
• Copyright, portrait, or privacy-infringing content
• Voyeuristic recordings (e.g., restrooms, bathrooms)
• Scatology, urination, vomiting, feces
• Violent or brutal sexual expressions (e.g., fisting, choking, spanking)
• Unauthorized interior shots under clothing
• Incomplete model age verification or missing documents
• Content repurposed from other sites or devices
• Content promoting pyramid schemes or multilevel marketing
• Defamation or slander
• Human trafficking or abuse promotion
• Content without verified consent of participants
• Other materials deemed inappropriate by the Site

Strict Ban & Immediate Action:
The following items, if detected, will result in immediate suspension and account freeze:

• Child pornography
• Uncensored genital media
• Resale items

Note: Any depiction involving minors under 15, including "JS"/school-themed items, is strictly prohibited. Bestiality-related content (visuals, tags, etc.) is also banned.

Article 6 – Permitted Products for Sale

Only products that meet all of the following conditions may be sold on the Site. Sellers must confirm compliance before registering any content:

• The seller must hold legitimate rights to the product and not infringe on third-party copyrights, portrait rights, or privacy rights
• The product must comply with Japanese laws and not be illegal to possess, distribute, or sell
• The product must not promote unlawful solicitation (e.g., pyramid schemes, MLM)
• The product must not include defamation or expressions that damage reputations

Article 7 – Sales Rules

Sellers must comply with the following rules when listing products:

• Do not register duplicate listings of the same content (except bundled sets)
• Be sure to check appropriate options (e.g., "resale", "no audio", "4K")
• Do not use external uploaders for content delivery
• Do not advertise or promote other marketplaces
• Product descriptions must be clear, accurate, and honest
• The Site may suspend or delete listings at its own discretion if rules are violated
• Do not include statements such as "No refunds or complaints accepted" in product descriptions. If necessary, the Site may issue refunds on behalf of the seller
• Sample images must be captured from the actual video and accurately represent the content
• Sample image edits are allowed only for genital blurring, facial mosaics, and text overlays. Excessive editing or misleading collages are prohibited

Article 8 – Response to Violations

If a violation is suspected, the Site may take the following actions:

• Temporarily suspend sales of the relevant product while investigating
• Delete or suspend products found to be in clear violation
• Remove content based on valid requests from participants, related parties, or rights holders
• The Site reserves the right to take independent action and will not accept appeals
• Even if the seller disagrees, the Site may prohibit sales if deemed inappropriate

Article 9 – Copyright and Consignment Sales

Sellers must guarantee that their products do not infringe on third-party rights.

If a copyright violation is suspected, the Site may request:

• Original unedited images taken during filming (e.g., Exif data)
• Valid documentation proving a consignment sales agreement (including contractor name, contact, and terms)

If these cannot be provided, the Site may suspend sales at its discretion.

Article 10 – Product Responsibility

Sellers must ensure their digital content is legal and free of defects.

• Sellers are fully responsible for any disputes or legal claims with third parties
• If content is corrupted or non-functional, sellers must provide replacements or issue refunds
• The Site is not responsible for the quality of digital content

Article 11 – Sale Period and Deletion

Sellers may suspend sales voluntarily. However, content cannot be deleted until the download period for buyers has expired.

The Site may delete products if:

• A terms violation is confirmed
• The seller fails to submit ID or consent documents
• A removal request is received from police, courts, payment processors, or ISPs
• The product has been unpublished for 14+ days
• A newly registered product remains unpublished for 14+ days
• The seller fails to respond to a correction request within 14 days

Article 12 – Product Limits and Fees

The Site generally does not limit the number of listings, but may impose restrictions if:

• It determines the seller is artificially inflating listings

Fees:

• Upon sale, fees and affiliate commissions are deducted from the sales price
• Fees apply per product sold, even in bundled purchases
• The fee rate may change with advance notice

Article 13 – Payments and Payouts

Sellers' earnings are paid under the following conditions:

• Payments are made at the end of the month following the sales month, provided earnings exceed ¥10,000
• Transfer fees (¥300 + tax) are borne by the seller and deducted from the payout
• If a remittance error occurs, a retransfer fee (¥600 + tax) will be charged and payout will be postponed to the second following month

Article 14 – Sale Cancellations and Refunds

The Site may cancel sales or issue refunds in the following situations:

• If a credit card is used fraudulently or the payment is declined and the card issuer cancels the transaction
• If the Site deems a refund appropriate due to inadequate response from the seller to a customer complaint

Even if the sales amount has already been paid, the Site may deduct the amount from the next payout or request repayment from the seller.

Article 15 – Consumption Tax

If the seller's primary business location is within Japan, the seller shall be deemed to understand and agree to the application of the reverse charge mechanism regarding consumption tax on sales via the Site.

Article 16 – Suspension and Termination of Membership

The Site may suspend or terminate a seller’s membership without prior notice under the following conditions:

• Violation of the Terms
• Falsification of registration information
• Inability to contact the seller
• Unauthorized use of passwords
• Actions that harm the Site
• Defamation or harassment of the Site or other members
• Any conduct deemed significantly inappropriate by the Site

Serious violations such as the sale of uncensored content or child pornography may result in:

• Immediate account termination
• Freezing of unpaid earnings
• Reporting to relevant authorities

Article 17 – Account Termination

Sellers may freely terminate their account via the form provided in their My Page.

• If the unpaid earnings amount is ¥3,000 or more, the balance will be transferred after deducting transfer fees
• After account termination, the Site has no obligation to retain any product files

Article 18 – Governing Law and Jurisdiction

These Terms shall be governed by and interpreted under the laws of Japan.
Any disputes arising in connection with the Site shall be subject to the exclusive jurisdiction of the court designated by the Site as the court of first instance.

Article 19 – Reporting Violations

If a member discovers a violation of these Terms by another seller, they may report it to the Site's operations office.
The Site will determine the validity of the report at its sole discretion and will not disclose the results.

Article 20 – Revisions to the Terms

The Site may revise these Terms when necessary.
Revised Terms shall take effect upon being posted on the Site, and any continued use thereafter shall be deemed acceptance of the revised Terms.

Article 1 – Scope of Application

These Terms apply to all affiliate members (hereinafter referred to as "Members") participating in the affiliate program of Pcolle (hereinafter referred to as “the Site”).
Members are also deemed to have agreed to the Pcolle General Member Terms of Use.

Article 2 – Registration and Participation Requirements

Registration for the affiliate program is free. No joining fees or monthly fees apply.
To participate, applicants must accurately fill out the required fields on the registration form provided by the Site.
The Site may reject or revoke registration under the following conditions:

• False or inaccurate registration details
• Invalid or nonexistent promotional URLs
• Lack of verifiable promotional activity
• Applicant is found to be under the age of 18
• Promotion channels contain illegal or discriminatory content
• If the Site deems the registration inappropriate at any time after approval
• Prolonged periods of non-communication may result in suspension or deletion of the account

Article 3 – Affiliate Commission

Commissions are earned when a customer accesses the Site via an affiliate link provided by the Member and completes a purchase.
The commission amount is calculated as:
Sales Price × Affiliate Rate (which can be freely set by the seller between 10% and 50%).
If the customer purchases additional items after following the affiliate link, those are also commission-eligible.
Self-affiliation is not prohibited, but if there is no verifiable promotional activity, restrictions or account suspension may be imposed. Promoting one's own products is allowed, but unjust defamation of other sellers’ products is prohibited.

Article 4 – Commission Payments

If total commissions exceed ¥10,000, payment will be made to the domestic bank account designated by the Member.
For first-time payouts, both the initial bonus and affiliate commissions must exceed ¥20,000 combined to qualify for payment.
Commissions are calculated monthly (end of month), and paid at the end of the following month.
If that day is a banking holiday, payment will be made on the next business day.
Transfer fees (¥300 + tax) are borne by the Member and deducted from the payout.
In the case of a remittance error, the reversal fee (¥600 + tax) and retransfer fee will be deducted from the next payment.
The Site may request identity verification documents if deemed necessary.
If verification is not completed, payment may be withheld.
Unpaid commissions from months where payout criteria were not met will not expire; they will carry over and be paid once the ¥10,000 threshold is reached.

Article 5 – Commission Bonus Program

Members may receive a rank based on previous month’s earnings, entitling them to a 1%–8% bonus per sale (Bronze to Diamond levels).
If the previous month’s commission exceeds ¥10,000, a ¥5,000 P Point bonus is awarded.
To receive the bonus, the Member must have linked their account with a Buyer account beforehand.
Retroactive linkage does not qualify.
Bonus conditions and rank details may be revised with advance notice.

Article 6 – Prohibited Conduct

The following actions are strictly prohibited. If a Member is found to have engaged in any of them, the Site may cancel earned commissions, suspend the account, terminate the agreement, or take legal action:

• Promotions using false or exaggerated claims
• Defamation or identification of models or sellers
• Undermining other sellers’ reputations unfairly
• Unauthorized use of media (videos, images, etc.)
• Using Pcolle materials solely to direct traffic to other sites
• Using promotional content that does not actually promote Pcolle or its products
• Creating fake websites or pages imitating Pcolle
• Reproducing the Pcolle homepage or gateway page
• Unauthorized use of the Pcolle logo, icons, or brand-like designs
• Misrepresenting oneself as an "official account" on social media or elsewhere
• Running ads under the name "Pcolle" without permission
• Causing excessive server load
• Embedding Pcolle in redirects, pop-ups, or frames
• Promotions that collect users’ personal data or email addresses
• Unauthorized automated promotions using scripts or bots
• Promoting content that violates public order or morality
• False pricing or misleading promotional language
• Spamming or unauthorized mass emails
• Repeated self-affiliation with the intent to abuse the system (e.g., purchasing one's own products excessively)

Article 7 – Response to Removal Requests

If a Member is asked to modify or delete content by a model, seller, rights holder, relevant party, or the Site's operations team, they must respond promptly.
Failure to do so may result in withheld commissions, account suspension, or other disciplinary action.

Article 8 – Updates to Registration Information

If the Member changes any registration details (such as bank account or promotional site URL), they must promptly update this information via their My Page.
The Site is not responsible for issues caused by failure to update contact details.

Article 9 – Account Termination and Unpaid Commissions

Members may cancel their account at any time through the form provided in their My Page.
If the unpaid commission balance exceeds ¥3,000 at the time of termination, payment will be made after deducting transfer fees.
Affiliate sign-up bonuses will only be paid if all associated conditions are met.
Bonus and campaign terms are subject to change or termination without prior notice.
If the Member terminates their account before meeting the conditions, those bonuses will expire and not be paid.

Article 10 – Disclaimers

The Site is not liable for tracking failures, broken links, inaccurate click counts, or commission calculation errors resulting from the Member’s promotional activities.
Unintended behavior may occur due to third-party system updates or browser changes.

Article 11 – Handling of Personal Information

The Site will not share Members’ personal information with third parties unless legally required by a court order or equivalent.
In such cases, the Member will be notified in advance when possible.

Article 12 – Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with Japanese law.
In the event of any dispute related to the Service, the court designated by the Site shall have exclusive jurisdiction as the court of first instance.
